PRIVACY POLICIES

REGULATION GOVERNING THE PRIVACY AND CONFIDENTIALITY POLICIES OF USER INFORMATION ON THE EPIC E-WALLET PLATFORM.

EPIC is a service provided by TECHNOLOGY DEVELOPERS LLC. 

TECHNOLOGY DEVELOPERS, LLC is the owner, developer, distributor, controller, and responsible party for EPIC E-WALLET.

TECHNOLOGY DEVELOPERS LLC is the company responsible for the treatment and custodianship of your data concerning the provision of EPIC E-WALLET services in the United States of America and around the world. We are duly incorporated, registered, and located in the state of Florida, USA. 

The privacy and confidentiality of user information are very important to TECHNOLOGY DEVELOPERS LLC and to the EPIC E-WALLET platform (hereinafter EPIC, we, us, our, and similar terms as appropriate) in its capacity as the sole owner, developer, distributor, controller, and manager of the EPIC platform. It is for this reason that we take precautions and exercise the necessary and pertinent resources to protect your information, using the most complete, modern, and effective information protection information security mechanisms. EPIC is committed to protecting and safeguarding the privacy of the information of our clients and users with the utmost seriousness and professionalism.  

This document is an Adhesion Contract that you sign and accept and is an integral and complementary part of EPIC’s General Terms and Conditions of Use and all Commercial Conditions and other Contractual Documents that may relate to you and EPIC. By accepting at the time of your registration and access to the EPIC platform, you declare that you accept the privacy and confidentiality policies and conditions contained herein, which apply to all trading services, the platform, and any related product or service that offer EPIC, regardless of how they are accessed or used. They describe privacy and confidentiality rights for the collection, use, storage, distribution, and protection of your personal information. We also refer to the use of EPIC and its applications, APIs, connections, services, content, or similar by you, available through the EPIC platform, and its interconnections, which are subject at all times to the regulations, terms, policies, and EPIC conditions. 

OBJECT

At EPIC and throughout its ecosystem, we care about your privacy and are committed to processing your personal information per good information practices and applicable data protection laws to provide better service.

At EPIC, we are committed to helping our clients protect and move their money to their best advantage. This commitment to our customers and users includes the protection and proper use of your personal information.

This document contains the rules that govern the Privacy and Confidentiality Policies to be applied to the personal information supplied or provided to EPIC by THE USER thereof, or by other sources, to regulate the rights of privacy and confidentiality of said information for its obtaining, compilation, collection, reception, investigation, verification, storage, use, distribution, dissemination, protection, and/or preservation, in relation to the provision of services through EPIC.

The purpose of our Privacy Policies is to always protect your personal information once it has been obtained by us, as well as to be able to communicate, when necessary, how we collect, use, store, protect, disclose, and share your personal information when you use any of our services from the EPIC platform.

We agree that EPIC may engage in processing activities with other platforms or with proprietary platforms, such as Know Your Customer (KYC) activities, which are necessary for us to provide the Services to you or otherwise a better Service. These EPIC entities may act as Controllers of your personal information and use it in accordance with these Privacy Policies.

ADMISSION AND LEGAL CAPACITY

In today’s globalized world, we all want to participate, but for the best development of the EPIC platform, we are concerned and request that THE EPIC USER be legally able to contract in the United States of America and the rest of the world. Whoever contracts with EPIC, or in any way uses or is related to its services must be of legal age (in most cases and laws OVER 18 YEARS) for the jurisdiction to which it corresponds and, in addition, have the capacity to contract and make use of the EPIC Platform. EPIC grants permission to use our services to anyone with the legal capacity to do so, of course, doing due diligence to prevent offenders from using the EPIC Platform for their misdeeds, such as those mentioned below in the last paragraph of the section «How Epic Shares Your Information.” However, EPIC could allow a person under 18 years of age to use the platform as long as they are under the supervision and guardianship of their representative, therefore, for their access and mobility within the EPIC ecosystem, they must be authorized and under the supervision and consent of their parents, or the legal guardian, or whoever has the legal exercise of parental authority, guardianship, and custody, as the case may be. EPIC always reserves the right of admission. Likewise, this condition must be met and fulfilled as considered or allowed by the legislation and conditions of the country of origin. 

EPIC reserves the right of admission and suspension in accordance with its internal policies and concatenated with the applicable legislation according to the case. Any person who is suspended or disabled, temporarily or permanently, from the use of the EPIC platform must refrain, at all times, from the direct, indirect, or intermediary use of the platform or from trying to register again to try to achieve their inclusion. as a user, until the sanction to which he is subjected ceases, and his entry is allowed.

INFORMATION THAT EPIC COLLECTS AND PROCESSES

When you use or access our Services or our websites or apps, we collect personal information about you under the strictest privacy and confidentiality controls, and we may use it in conjunction with other information collected or generated during our relationship with you.

The data that the EPIC platform obtains from THE USER, is treated under the general principles of privacy, confidentiality, legality, consent, information, quality, purpose, loyalty, protection, proportionality, and responsibility, and they are mainly obtained directly or indirectly; other lawful mechanisms or adequate means may arise to access user information. 

  • a) DIRECT INFORMATION:

Each USER who registers and opens his account must provide the EPIC platform with the data that identifies him, such as:

  • Names and surnames
  • Birthdate
  • Civil status
  • Profession, Occupation, or Trade
  • Personal or Government Identification Numbers
  • Place of Residence or Home Address
  • Device ID
  • Fixed Telephone Number
  • Mobile or Cell Phone Number
  • Email address
  • Nationality or Citizenship
  • Language (the one you interact with us)
  • Gender 
  • b) AUTOMATIC INDIRECT INFORMATION:

EPIC collects information from THE USER when he connects to the platform; it is generated by automatic transmission from his phone, computer, or another mobile device. This generalized information is related to THE USER and his devices, and we could be talking about:

  • Data about the pages to which you have access
  • The Internet IP address that you use to communicate on the computer
  • Device ID or password or unique identifier
  • Version and type of device or browser
  • Operating system and platform used by your browser
  • Types and versions of your browser connection
  • Geolocation and time zone configuration
  • Computer information and your internet connection
  • Mobile network information
  • Information through cookies and other tracking technologies
  • Statistics of the number and time of visits to pages
  • Time-stamped history of traffic to, through, and from websites
  • Reference Uniform Resource Locator (URL)
  • The number of cookies to measure and improve the effectiveness of the service.
  • Identification of your device for analysis, diagnosis, and prevention of fraud and malware
  • Commercial data
  • Standard web registration data
  • Any other relevant technical information 
  • c) SPECIAL INDIRECT INFORMATION:

If necessary, EPIC could obtain special information from its USERS; these requirements would be made in a special and specific way, and sometimes personally, using electronic, telephone, postal, governmental, or other communications, and in reference to:

  • Biometrics
  • Fingerprint images
  • Demoscopic inquiries
  • Verification of accounts presumably controlled, totally or partially, by THE USER.
  • Service quality research
  • Instruction and/or training of THE USER
  • Security and protection of THE USER’s account.
  • Any other pertinent special information

EPIC may, for security and protection reasons, record the conversation that THE USER has with it in the cases that apply.

  • d) INFORMATION FROM EXTERNAL SOURCES:

Through this Accession Contract, THE USER duly authorizes EPIC to collect, at all times, information automatically or from the network, coming from third parties and/or providers of technical, research, and/or identity verification services, who also possess and can provide or provide information about themselves, such information may be stored, processed, verified and used in accordance with these policies and current legal regulations.

INFORMATION SOURCES

All the sources of information mentioned in this document are manifestly accepted and authorized, in each and every one of its parts, by THE USER, who thus accepts and subscribes when using the EPIC platform, through this Adhesion Contract.

All the data that THE USER has provided to EPIC are true and verifiable and thus, by adhering to this Contract, he certifies it, otherwise, his account may be subject to suspension, leaving THE USER disabled to operate it until he sends legitimate, verifiable evidence to EPIC, true and trustworthy of their identity.

Once registered, THE USER accepts EPIC’s Privacy and Confidentiality Policies contained in this document, and that they will apply to all operations services, personal information, the platform, and any other product or service related or related that EPIC offers, regardless of the form, manner or mode of its access or use in each case.

SECURITY AND STORAGE OF INFORMATION

THE USER has provided his data when registering with EPIC, and from that moment, they are stored on the servers used by the said platform. In this sense, THE USER declares to be informed in this regard and authorizes the transfer within the United States of America or to the rest of the world of the data provided.

Permanently, EPIC collects, processes, stores, encodes, and protects the personal information of each of its Users, through the exclusive use of secure servers, for which it uses the security and privacy standards of the information industry applicable in terms of protection of confidentiality and emphasizing the security, administrative, legal, technical and physical measures that are relevant and necessary for the commitment and development of these Policies through the use of data encryption, firewalls (firewalls) and Secure Socket technology Layers (SSL) so that all data and transactions remain and flow encrypted.

THE USER is responsible for not disclosing to third parties the data that has been provided to EPIC for their interrelation through it.

EPIC warns that per the provisions contained in the Special Laws of the United States of America and of the Countries with which EPIC is interrelated Against Computer Crimes, all computer systems are susceptible to being hacked or illegally violated; therefore, in this case, EPIC will not be responsible for the illegal access, capture, interception, interruption, plagiarism, reproduction, falsification, alteration, diversion, or elimination of the data or signals of transmission or communication belonging to or coming from THE USER and that this contributes to any anomaly or illegality. EPIC, always concerned with and attached to these Policies, Rules, and Laws will seek a way to protect the data of THE USER and its interrelation with the platform.

PRIVACY

EPIC only uses the personal information that it has stored on its servers to be able to carry out the transactions that THE USER carries out in the EPIC platform community, therefore, EPIC will not sell, lend, assign, disclose, lease, share, or exchange personal information obtained with another User or with a third party, except in the ways established in this document of Privacy and Confidentiality Policies. However, when registering, THE USER adheres, consents, accepts, and expressly agrees that EPIC transfers all or part of the personal information to any of the controlling, controlling, associated, and/or linked companies to EPIC, by any title and at the time, form and conditions that it deems pertinent; for the operations of the platform, operations in which the privacy and confidentiality of the information must be preserved.

THE USER is solely responsible for understanding and complying with each and every one of the laws, rules, regulations, and policies that may apply to him concerning his use of the EPIC platform.

USE OF INFORMATION:

As we have already said and seen previously, the information that THE USER delivers to EPIC can be used on its platform for the following:

  • Validate the identity of THE USER.
  • Process, validate, and accept the transactions that THE USER carries out on the EPIC platform.
  • Communicate to THE USER about the use of the products and services provided by EPIC.
  • Notify THE USER about any change that occurs in the Terms and Conditions of the relationship between him and the EPIC platform.
  • Provide a response to THE USER on any information required and provide the relevant support.
  • Ask THE USER for necessary and pertinent information or data.
  • Adapt the content of the information sent to you.
  • Provide personalized advice and help regarding EPIC and the services and products provided through it.
  • Transmitirle información que valoramos necesaria y que, aun cuando no la haya solicitado, se estime que pueda interesarle.
  • Send you information, newsletters, offers, promotions, flyers, WhatsApp, and texts related to the products and services provided through the platform or in any case through any of the social networks.
  • Evaluate the behavior and frequency of use of the EPIC platform by THE USER, both individually and in the aggregate, for research and analysis purposes and to be able to manage, supervise and improve the provision of services.
  • Protect users, as well as the company, its assets, and the EPIC operating system and its products, against fraud or other types of illegal activities that could affect them.
  • Others deemed pertinent according to the text of this document.

HOW EPIC SHARES YOUR INFORMATION:

When sharing your data with other EPIC entities associated with, contracted with, allied with, or acting with EPIC, we will do our best to ensure that such entity is subject to these Privacy Policies or follows practices that are at least as protective as those described in these Privacy Policies. It is, therefore, that THE USER of EPIC grants, authorizes, and gives his acquiescence to this platform so that he can share certain data of his personal information with other users of said platform, with third-party allies, with third-party non-users of the same, and/or with the administrative or judicial authority that by its powers, and/or according to what was said before, we see, then, several ways of sharing information: 

  • a) INFORMATION SHARED WITH OTHER USERS:

EPIC develops its activities with third-party allies that receive or send payments, received, or sent automatically, by THE USER through the said platform.

When the payment is verified, a third-party user can share, through the use of the said platform, information containing data of THE USER, to automatically confirm his condition as such, which allows him to complete an operation to receive or send a payment in a correct and safe.

THE USER who sends a payment through EPIC, when using the telephone number, data, or address of the recipient of the payment, will automatically be shown on the platform the pertinent data of the receiving USER so that the sending USER verifies that he is paying to the account correctly selected by him.

  • b) INFORMATION SHARED WITH THIRD PARTIES:

EPIC works with other group companies, other platforms, banks, payment processors, databases, suppliers, and other commercial companies, to which it allows limited access to certain contact information of its Users, so that they can receive or remit payments of THE USER or towards THE USER; in such a way that, the third-party ally may share with EPIC and vice versa, information of THE USER related to his name, cell phone number, email, and address, in order to notify him of the receipt or remittance of a payment to a third party or a trading company.

It is understood that the third party that uses the information of THE EPIC USER to confirm the condition of the User in the platform and, consequently, that it can be enabled as a vehicle for sending or receiving payments or notifications referring to the status of the payment, in no case and under no circumstances will you be allowed to use the information for purposes other than those of the execution of the operation to be carried out.

The information that EPIC has of the Users is and will always be private and confidential, it will be used only for real identification of THE USER and for transactions on the platform. EPIC will never make public or deliver under any other circumstances the information of any of its users unless THE USER duly consents or under the due request of the competent authorities or imperative of the Law. 

  • c) INFORMATION SHARED WITH OTHER THIRD PARTIES:

We may share information related to the data of your Users with Other Third Parties, some of which are indicated below:

  • Financial Institutions: EPIC may associate, agree or contract with Financial Institutions as a vehicle for remitting or receiving payments for the service of the platform, or to jointly create and promote products related to EPIC; therefore, you may share your Users’ information with such institutions that may only use the shared information for the use and marketing of EPIC products or services.
  • Other Companies: EPIC may share information about its Users with Companies with which it is in negotiations for the merger, sale, or acquisition of the platform, for which EPIC will require that the new company that arises from the negotiation adopt and continue with the Policies of Privacy of the information corresponding to its Users. If the personal information of THE USER could be affected or used in a different way or contrary to what is established in this document, THE USER will be notified on time.
  • Competent Authorities: EPIC will share information about its Users in compliance with the requirements, demands, and/or instructions that, in accordance with the provisions of the Laws that apply, are formulated by the Competent Authorities in administrative procedures or in judicial processes, in which it is necessary to disclose to such authorities personal information related to some of its Users. For this, if and only if, only what is duly requested and conducive will be revealed.

Notwithstanding the foregoing, even when there is no requirement from any competent administrative or judicial authority, EPIC, given the presumption that there are irregularities, is obliged to act ex officio and disclose information to the competent authorities, related to personal data and/or movements of the accounts of its Users, when it deems it appropriate, pertinent, and necessary, to avoid the execution of illegal acts, and; consequently, an investigation related to suspected fraud, theft, fraud, money laundering, financing of terrorism, white slavery, drug trafficking or narcotic and psychotropic substances, smuggling, affectation of industrial, commercial or intellectual, affectation to the world financial system, designated person and, any, other illegal activity that may affect EPIC, its Users, employees, managers, and assets, as well as allied financial institutions and other third parties related to EPIC; in addition to the fact that it may affect the security of the United States of America and of any other Nation involved.

CHANGES IN THE PRIVACY POLICIES:

THE EPIC USER consents to accept and agree that EPIC, at any time, can change, modify, or update these Privacy and Confidentiality Policies and that only by publishing the latest version, EPIC accept and validates them, since in the application will always be at your disposal.

These updates are due to the avant-garde and constant innovation found in the technological world and electronic transactions, intending to always improve the conditions for the provision of the service, as a result of the application of advances and technological innovations or legal requirements. In any case, any change, modification, or update of these Policies will be made appropriately known to THE USER, through publication on the EPIC platform, and only by publishing the update on the said platform will it be resolved by full right.

OWNERSHIP

EPIC declares jointly with THE USER, who accepts and agrees, that the property, domain, control, and ownership of EPIC, of the company that owns the EPIC brand and/or platform, of the subsidiaries, that EPIC may own and own, of The industrial or copyright rights of the company or the EPIC platform, are not, nor will they ever be in dispute about their ownership or ownership since THE USER hereby acknowledges and declares.

APPLICABLE LAW AND COMPETENT JURISDICTION:

Both EPIC and THE USER expressly agree that these Privacy and Confidentiality Policies, as well as the interaction that derives from them between the parties, are governed by this document as well as by the Laws in force in the United States of America that may apply. applicable in each case.

Likewise, they agree that any difference between the parties will be resolved through a conciliation agreement between the parties; In this case, THE USER must first send a written communication to EPIC notifying their situation and proposing the possible solution to their requirement, all of which will be evaluated, as the case may be, by the Department of Customer Service, KYC, Technical, IT and/or o Legal of the EPIC platform.

In the same way, if the conciliation agreement indicated and provided for in the previous paragraph has not been reached, the parties agree to choose the United States of America as the special, sole, exclusive, and excluding domicile, and it will be through the figure of Commercial Arbitration. that the differences be settled, all of this to resolve and/or settle any dispute that may arise or arising as a result of the use of EPIC and/or the application of these Privacy and Confidentiality Policies, their existence, validity, interpretation, scope, compliance and other derivatives and consequences.
